Indoor Golf Bay Use Waiver & Release of Liability

PLEASE READ CAREFULLY BEFORE PARTICIPATING
By booking an indoor golf bay reservation, I acknowledge that I have voluntarily chosen to participate in activities at The Birdie Bar, including the use of indoor golf simulators, golf equipment, and surrounding facilities.

My reservation to use The Birdie Bar’s indoor golf simulator bay is my acceptance of the terms below. This acceptance applies to myself and all persons in my party.

1. Assumption of Risk

I understand that golf activities—whether real or simulated—involve inherent risks, including but not limited to:

• Being struck by a golf ball, golf club, or other equipment
• Slips, trips, or falls on playing surfaces or around simulator bays
• Physical strain from swinging clubs or other motions

By entering and using The Birdie Bar facilities and equipment, I voluntarily assume all such risks, whether known or unknown, and accept full responsibility for my participation.

2. Release & Waiver of Liability

The Birdie Bar is not responsible for injuries or accidents to you caused by golf balls, golf clubs, golf tees, or golf swings. By entering the premises you are agreeing to adhere to this notice and assume all risks and liabilities for you and your entire party.

In consideration of being permitted to use the facilities at The Birdie Bar, I hereby release, waive, discharge, and hold harmless The Birdie Bar LLC, its owners, officers, employees, and agents from any and all liability for injury, loss, or damage—whether to myself, my party, my property, or others—arising out of or connected with my participation, whether caused by negligence or otherwise, to the fullest extent permitted by law.

3. Safety Rules

I agree to follow all posted and verbal safety instructions, including:

• Only one player may swing a club at a time in each bay.
• All guests must stand behind the hitting area when another player is swinging.
• No running, horseplay, running golf swings, or unsafe use of equipment.
• I will report damaged equipment or unsafe conditions to staff immediately.

4. Alcohol Consumption

If I choose to consume alcohol on the premises, I certify that I am 21 years of age or older, will drink responsibly, and will not engage in unsafe activities under the influence.

5. Photo & Video Release

I grant The Birdie Bar permission to use any photographs or video taken of me during my visit for promotional or marketing purposes without compensation, unless I notify management in writing before participation.

6. Minors

An authorized adult, parent, or guardian must accept these terms for any participants under the age of 18 and must supervise minors at all times.

7. Damages

You will be held financially responsible for any lost revenue or damage due to destructive use of The Birdie Bar indoor golf or miniature golf facilities.

8. Code of Conduct

We reserve the right to refuse service to anyone who is intoxicated, disruptive, offensive, or poses a threat to the safety or adversely affects the comfort of our employees or other customers.
