THE BUNKERR GOLF LOUNGE LLC

PARTICIPANT WAIVER AND RELEASE OF LIABILITY

By signing this waiver, I acknowledge and agree to the following terms and conditions for participation at The Bunkerr Golf Lounge LLC (“The Bunkerr”), located at 801 S. University Dr, Suite C-138, Plantation, FL 33324.

1. ASSUMPTION OF RISK

I understand that participation in golf simulator activities, including swinging golf clubs, hitting golf balls, using simulator equipment, participating in contests, leagues, events, food and beverage consumption, and moving throughout the facility involves inherent risks, including but not limited to:

• Being struck by golf clubs or golf balls
• Slipping, tripping, or falling
• Equipment malfunction or misuse
• Injuries resulting from physical activity
• Injuries caused by other participants

I voluntarily assume all risks associated with participation at The Bunkerr.

2. RELEASE OF LIABILITY

In consideration for being allowed to participate in activities at The Bunkerr, I hereby release, waive, discharge, and hold harmless The Bunkerr Golf Lounge LLC, its owners, employees, contractors, affiliates, sponsors, and representatives from any and all claims, liabilities, damages, injuries, losses, or expenses arising out of or related to my participation, including those caused by negligence to the fullest extent permitted by Florida law.

3. PROPERTY DAMAGE

I agree to be financially responsible for any damage caused by me or members of my party due to reckless, intentional, or negligent behavior, including damage to simulator equipment, screens, clubs, televisions, furniture, or facility property.

4. RULES AND SAFE CONDUCT

I agree to follow all posted rules and instructions provided by staff, including but not limited to:

• Only one person swinging at a time
• Remaining outside the designated hitting area unless actively participating
• No horseplay, running, or unsafe conduct
• Using equipment only as intended
• Following all food and alcohol policies

The Bunkerr reserves the right to remove any guest behaving in an unsafe or disruptive manner without refund.

5. ALCOHOL POLICY

I acknowledge that alcoholic beverages may be served on the premises. I agree to drink responsibly and understand that intoxicated or disorderly guests may be removed from the premises without refund. I further acknowledge that I am solely responsible for my actions while under the influence of alcohol.

6. MEDICAL CONSENT

In the event of an emergency, I authorize The Bunkerr staff to seek medical treatment on my behalf if necessary. I understand that I am solely responsible for any medical costs incurred.

7. PHOTO AND VIDEO RELEASE

I understand that photos and videos may be taken during events, leagues, or normal business operations for promotional and marketing purposes. By signing this waiver, I grant The Bunkerr permission to use my likeness in promotional materials, social media, and advertising without compensation.

8. MINORS

Participants under the age of 18 must have this waiver signed by a parent or legal guardian. Parents/guardians accept full responsibility for the minor’s participation and conduct.

9. GOVERNING LAW

This agreement shall be governed by and interpreted in accordance with the laws of the State of Florida.

10. ACKNOWLEDGEMENT

I have carefully read this Waiver and Release of Liability and fully understand its contents. I understand that I am giving up substantial legal rights by signing it, and I sign it voluntarily.
