GOLF SIMULATOR LIABILITY WAIVER 1.Assumption of Risk
I understand that participating in golf simulator activities involves inherent risks, including but not limited to being struck by golf balls or clubs, slips or falls, equipment malfunction, and physical strain. I voluntarily assume all such risks
2. Release of Liability
I release and discharge The 19th, its owners, employees, and agents from any and all claims, damages, or causes of action arising from my participation, including injuries or property damage caused by my actions, the actions of others, or ordinary negligence. This release does not apply to gross negligence or intentional misconduct.
3. Participant Responsibilities
I agree to:
Follow all posted rules and staff instructions
Use equipment only as intended
Ensure the area is clear before swinging
Avoid reckless or dangerous behavior
Report unsafe conditions immediately
I understand that failure to follow rules may result in removal without refund.
4. Health and Physical Condition
I certify that I am physically able to participate and have no medical conditions that would make participation unsafe.
5. Equipment Damage
I agree to be financially responsible for any damage I cause to the simulator, screens, sensors, clubs, or facility property due to misuse or negligence.
6. Photo/Video Release (Optional)
I grant permission for The 19th to use photos or videos taken during my visit for marketing purposes. ☐ Yes ☐ No
7.Minors
If the participant is under 18, a parent or legal guardian must sign below and accept full responsibility for the minor’s actions and safety.
8 Governing Law
This agreement is governed by the laws of the State of Missouri.
9. Acknowledgment and Signature
I have read and understand this waiver. I am signing voluntarily and acknowledge that I am giving up certain legal rights.
