Indoor Golf Simulator Facility Waiver & Release of Liability
This Waiver & Release of Liability (“Agreement”) is entered into by the undersigned participant and/or parent/legal guardian for access to and use of the indoor golf simulator facility, equipment, and related premises.
1. Assumption of Risk
I understand and acknowledge that participation in golf simulator activities involves inherent risks, including but not limited to bodily injury, property damage, slips, falls, swinging golf clubs, flying golf balls, and misuse of equipment. I voluntarily assume all risks associated with participation at the facility.
2. Parent/Guardian Responsibility for Minors
Parents and legal guardians are solely responsible for supervising and always controlling their children while on the premises. The facility and its owners, employees, and affiliates are not responsible for monitoring, disciplining, or supervising minors. Any actions, damages, injuries, or misconduct caused by minors due to inadequate supervision shall be the responsibility of the parent or guardian.
3. Property Damage Responsibility
Any damages caused to facility property, simulator equipment, televisions, furniture, walls, clubs, or any other items at the facility due to negligence, reckless behavior, misuse of equipment, anger-related conduct, horseplay, or failure to properly supervise children shall be the sole financial responsibility of the participant and/or parent or legal guardian involved.
4. Ball Rebound Exception
The facility acknowledges that golf balls may occasionally rebound or ricochet from simulator screens during normal and intended use. Except for incidents directly resulting from a standard ball rebound off the simulator screen, participants assume responsibility for all self-inflicted damage or injuries caused during use of the facility.
5. Conduct and Equipment Abuse
Participants agree to always conduct themselves in a safe and respectful manner. Intentional acts such as throwing or smashing golf clubs, damaging simulator equipment, striking walls or fixtures, or engaging in aggressive behavior may result in immediate removal from the premises and full financial responsibility for repairs or replacement costs.
6. Release of Liability
To the fullest extent permitted by law, the undersigned releases and holds harmless the indoor golf simulator business, its owners, employees, contractors, and affiliates from all claims, liabilities, damages, costs, or causes of action arising from participation at the facility, except, where prohibited by law.
7. Agreement
By signing below, I acknowledge that I have read and understand this Agreement and voluntarily agree to its terms.
