GOLF SIMULATOR/ MULTI SPORT ARCADE LIABILITY WAIVER & RELEASE

1. Acknowledgment of Risks
I understand that using a golf simulator/ multi sports arcade involves inherent risks, including but not limited to:

• Being struck by golf balls,clubs, or other sports equipment
• Slips, trips, or falls
• Equipment malfunction
• Physical strain or injury from swinging a club or sports activity

I acknowledge these risks could result in minor, serious, or even fatal injury, as well as property damage.

2. Voluntary Participation
I confirm that my participation is voluntary and that I am physically able to engage in golf simulator/ multi sport arcade activities. I hereby grant Full Swing Sports LLC the irrevocable right to use photographs and/ or video recordings of me ( or my minor child) for promotional and marketing purposes, including social media, website, and advertising, without compensation, and waive any right to inspect or approve the finished product.

3. Assumption of Risk
I knowingly and freely assume all risks, both known and unknown, associated with my participation.

4. Release & Waiver
In consideration for being allowed to use the golf simulator and related facilities, I hereby release, waive, and discharge Full Swing Sports, LLC, its owners, employees, agents, and affiliates from any and all liability, claims, demands, or causes of action arising from my participation, whether caused by negligence or otherwise, to the fullest extent permitted by Michigan law.

5. Indemnification
I agree to indemnify and hold harmless Full Swing Sports, LLC from any claims, damages, or expenses (including attorney’s fees) arising from my actions or omissions while using the facility.

6. Rules & Safety
I agree to follow all posted rules and staff instructions, including:

• Only one person swinging at a time
• No practice swings outside the hitting area
• Proper use of equipment at all times

7. Medical Treatment
In the event of injury, I consent to receive medical treatment deemed necessary and agree to be responsible for any related costs.

8. Governing Law
This agreement shall be governed by and construed in accordance with the laws of the State of Michigan.

I have read and fully understand this waiver. I am at least 18 years old, or I am the parent/legal guardian of the minor named below.
