"Bush League Sports Tavern" dba Bush League Sports Club, LLC
This Waiver, Release of Liability, and Assumption of Risk Agreement (“Agreement”) is entered into by the undersigned participant (“Participant”) in favor of Bush League Sports Tavern, including its owners, officers, managers, employees, agents, representatives, affiliates, successors, and assigns (collectively, “Bush League”).
Participant acknowledges and understands that use of golf simulator facilities involves inherent risks, including but not limited to:
Being struck by golf balls, golf clubs, or other equipment
Slips, trips, and falls
Equipment malfunction or improper use
Actions or negligence of other participants
Physical exertion that may result in injury
Participant knowingly and voluntarily assumes all risks, whether known or unknown, foreseeable or unforeseeable, associated with participation in golf simulator activities.
In consideration for being permitted to use the golf simulator facilities, Participant hereby releases, waives, discharges, and holds harmless Bush League from any and all claims, demands, damages, losses, liabilities, costs, or causes of action of any kind, including but not limited to those arising from:
Personal injury
Property damage
Illness
Permanent disability
Death
Whether caused in whole or in part by the negligence of Bush League, to the fullest extent permitted by applicable law.
Participant agrees not to institute any legal action or claim against Bush League arising from participation in golf simulator activities and agrees to indemnify and hold harmless Bush League from any claims brought by or on behalf of Participant.
Participant agrees to comply with all posted rules, safety guidelines, and verbal instructions provided by Bush League staff, including but not limited to:
Swinging golf clubs only within designated hitting areas
Maintaining safe distance from other participants
Refraining from reckless or unsafe behavior
Proper use of equipment
Bush League reserves the right to deny or revoke simulator access at any time for safety reasons, without refund.
Participant acknowledges that alcohol may be served on the premises and understands that consumption of alcohol increases the risk of injury. Participant agrees to participate responsibly. Bush League reserves the right to restrict or deny simulator access to any participant deemed impaired.
Participant represents and warrants that they are physically capable of participating in golf simulator activities and have no medical condition that would make participation unsafe. Participant assumes full responsibility for their physical condition and participation.
If Participant is under eighteen (18) years of age, this Agreement must be executed by a parent or legal guardian, who agrees to be bound by all terms herein on behalf of the minor.
Participant grants Bush League the irrevocable right to photograph and/or record Participant during participation and to use such images or recordings for marketing or promotional purposes without compensation.
If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
This Agreement shall be governed by and construed in accordance with the laws of the State of Oklahoma, without regard to conflict of law principles.
Participant acknowledges that they have read and fully understand this Agreement, understand that they are waiving substantial legal rights, and voluntarily agree to be bound by its terms.
