GOLF SIMULATOR PARTICIPANT RELEASE AND WAIVER OF LIABILITY AGREEMENT

Please read this document carefully before signing. By signing this document, you are waiving certain legal rights, including the right to sue voco Ardez Hotel its owners, officers, employees, and agents.

1. Acknowledgment of Risks

I, the undersigned participant, acknowledge and understand that participating in activities at [Business Name], including using golf simulators, hitting golf balls, swinging golf clubs, and being present in or around simulator bays, involves inherent risks. These risks include, but are not limited to:

• Physical injury caused by ricocheting or misdirected golf balls and broken equipment.
• Injuries resulting from swinging golf clubs, including trips, slips, falls, or accidental contact with other participants, spectators, or enclosure structures.
• Muscle strains, sprains, or other physical exertion injuries.
• Equipment malfunction or improper use by myself or third parties.

I voluntarily assume full responsibility for any and all risks of physical injury, illness, disability, death, or property damage arising out of or related to my participation in or presence at [Business Name], whether caused by negligence or otherwise.

2. Waiver and Release of Liability

In consideration for being permitted to enter voco Ardez Hotel and participate in golf simulator activities, I hereby agree that:

1. Release: I release, waive, discharge, and covenant not to sue voco Ardez Hotel, its parent companies, subsidiaries, affiliates, members, owners, officers, directors, employees, contractors, agents, and landlords (collectively, the "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury (including death) that may be sustained by me, or to any property belonging to me, while participating in simulator activities or while on the premises.
2. Indemnification: I agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, liabilities, costs, damages, or attorney fees arising out of my conduct, misuse of equipment, failure to follow safety guidelines, or injuries caused to third parties while on the premises.

3. Safety Rules & Operational Conduct

I agree to strictly follow all posted safety rules and verbal instructions provided by voco Ardez Hotel staff, including but not limited to:

• Only one person swinging inside the designated simulator hitting area at a time.
• All spectators and non-swinging participants must remain safely behind the safety line/barrier.
• Always check the surrounding area before swinging a club.
• No swinging of golf clubs outside designated hitting bays.
• Report any broken equipment or damaged turf immediately to staff.
• Refrain from operating or playing while under the influence of alcohol or controlled substances to an extent that impairs safe coordination.

voco Ardez Hotel reserves the right to terminate participation without refund if safety rules are violated.

4. Media Release

I grant voco Ardez Hotel permission to use photograph(s), video recordings, or digital images taken of me during my visit for promotional, marketing, or social media purposes without financial compensation.

5. Severability & Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State/Province of  California, USA. If any provision of this document is found to be unenforceable, the remaining provisions shall continue in full force and effect.

I HAVE CAREFULLY READ THIS RELEASE AND WAIVER OF LIABILITY AGREEMENT, FULLY UNDERSTAND ITS CONTENTS, AND SIGN IT FREELY AND VOLUNTARILY.
