Waiver and Release of Liability Agreement

1. Acknowledgment of Risks

I, the undersigned, acknowledge and agree that participation in activities at Serious Simulations, including but not limited to the use of golf simulators, sports equipment, and associated facilities, involves certain risks, including but not limited to:

• Physical injury from improper use of equipment or facilities.
• Slipping, tripping, or falling due to flooring, turf, cables, or equipment.
• Damage to personal property.
• Accidental contact with other participants or facility structures.
• Injury or death caused by flying objects, such as tees or balls, as soon as they step into the property, including but not limited to all activities and areas.
• Injury or death resulting from falling equipment, including but not limited to projectors, cameras, or other overhead installations.

I voluntarily assume full responsibility for any risks of injury, damage, or loss that may arise from my use of the facility.

2. Facility Rules and Guidelines

I agree to abide by the following rules and guidelines:

• Wear appropriate footwear (non-slip shoes) to minimize the risk of slipping.
• Refrain from tampering with cables, equipment, or flooring, including areas where Ethernet cables and turf are installed.
• Follow all safety instructions provided by facility staff.
• Immediately report any malfunctioning equipment or unsafe conditions to staff.
• Any individual behaving in a reckless, dangerous, or disruptive manner may be asked to leave the premises without refund.

3. Use of Equipment and Facilities

I acknowledge that:

• Golf simulators and associated equipment, including the Apogee system, Multisport cameras, and projectors, require proper handling as instructed by facility staff.
• Power connections and cables running through the facility, including under-floor conduit systems, are essential to the operation of the equipment and should not be interfered with.

4. Alcohol Consumption & BYOB Policy

Serious Simulations does not sell or provide alcohol. However, customers may bring their own beer or wine under the following conditions:

• Must be 21+ to bring, possess, or consume alcohol.
• No liquor or hard alcohol (beer and wine only).
• No excessive drinking—intoxicated guests will be asked to leave without refund.
• No sharing alcohol with minors under any circumstances.
• No glass bottles—all drinks must be in cans or plastic containers.
• Guests must behave responsibly and comply with all Texas laws regarding alcohol consumption.
• No drinking while actively using simulators—anyone appearing intoxicated while using equipment may be asked to stop for safety reasons.
• Serious Simulations reserves the right to refuse service or deny entry to anyone who is visibly intoxicated or acting irresponsibly.

Assumption of Responsibility & Release of Liability

I acknowledge that I am responsible for my own alcohol consumption and actions. I assume full responsibility for any risks, damages, or injuries that may arise due to my consumption of alcohol on the premises. I understand that Serious Simulations is not responsible for any alcohol-related incidents including but not limited to:

• Injuries sustained due to impaired judgment.
• Property damage caused by intoxicated individuals.
• Any legal consequences resulting from intoxicated behavior.

I release and discharge Serious Simulations, its owners, employees, and agents from any liability related to my consumption of alcohol while on the premises.

5. Release of Liability

In consideration of being permitted to enter and use the facility, I hereby waive and discharge Serious Simulations, its owners, employees, and agents from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or my property while on the premises, whether caused by negligence or otherwise.

6. Indemnification

I agree to indemnify and hold harmless Serious Simulations, its owners, employees, and agents from and against any claims, actions, damages, or liabilities arising from my use of the facility, including but not limited to any incidents related to alcohol consumption.

7. Medical Authorization

In the event of an injury or medical emergency, I authorize facility staff to seek medical assistance on my behalf. I understand that I am responsible for any costs incurred.

8. Photography and Media Release

I grant permission for Serious Simulations to use any photographs or videos taken during my visit for promotional or marketing purposes without compensation.

9. Acknowledgment of Agreement

I have read and understand this Waiver and Release of Liability Agreement, including the Alcohol Consumption & BYOB Policy. I voluntarily agree to its terms and conditions and acknowledge that this document is legally binding.

Serious Simulations Safety Guidelines

• Follow staff instructions and report any safety concerns.
• Wear non-slip shoes and avoid loose clothing.
• Use equipment only as instructed and maintain a safe distance from moving parts.
• Be mindful of cables and overhead equipment.
• Warm up before activities and stop if you feel unwell.
• Children must be supervised by an adult and stay in safe areas.
• Keep food and drinks away from equipment.
• Follow emergency procedures and familiarize yourself with exits and first aid stations.
• Be respectful of others and share equipment fairly.

SERIOUS BOOKING INSTRUCTIONS

Please arrive 10 minutes early to check in.

• MAX 4 PLAYERS PER BAY
• An average round of 18 holes takes 1.5 hours for one player.
• Staff will assist with food and beverage orders.
• If you are sick, please cancel your reservation online.
• Cancellations must be made at least 12 hours in advance. Cancellations made less than 12 hours prior to the scheduled tee time will be charged a 50% fee. No-shows will be charged the full amount.
• Tee times can be reserved up to 3 days in advance. Call for special event pricing.
• You are encouraged to bring your own clubs, but clubs are available to borrow (For a $10 Fee). Other sports equipment is provided - Limited tees, Multi-Sports Package, & Limited balls
• Parties of 6 are allowed at each bay.
